Many Ohio OVI cases still rely on the BAC DataMaster.


Even though newer machines exist, the DataMaster and its variations remain approved for evidential breath testing in Ohio. That matters because approval alone does not answer whether a specific result should be trusted or admitted.


Understanding what the BAC DataMaster is, and what it is not, is often the starting point for evaluating a breath test issue in an Ohio OVI case.

What the BAC DataMaster is


The BAC DataMaster is an infrared-based evidential breath-testing machine approved by the Ohio Department of Health.


Ohio also approves variations of this device, including the BAC DataMaster K and CDM models. While these machines share a common foundation, they are not identical in operation, maintenance requirements, or recordkeeping.


Because these are evidential machines, the state may attempt to use the reported number directly in court.


Approval does not end the analysis


A common misconception is that approval equals reliability.


In reality, the BAC DataMaster is subject to detailed rules governing calibration, maintenance, operator certification, and testing procedure under Ohio Administrative Code 3701-53.


If those rules are not followed precisely, the result may be subject to challenge. This is why DataMaster cases often focus less on general science and more on compliance with required procedures.


Why variations matter


Ohio courts treat the BAC DataMaster, BAC DataMaster K, and CDM as approved devices, but that does not mean they are interchangeable.


Each version may raise different issues related to recordkeeping, testing sequence, or internal safeguards. Identifying the exact model used is a necessary step before assessing whether a breath test result is legally sound.


How the BAC DataMaster fits into Ohio OVI defense


From a defense perspective, the key questions are practical ones:

  • Was the correct machine used

  • Was it properly maintained

  • Was the operator certified

  • Were required testing steps followed


These questions often determine whether a BAC DataMaster result becomes strong evidence or a contested issue in an Ohio OVI defense.
